Terms of Service

The rules for using this site and for any estimate or service agreement with 4th Gen Mechanical, LLC.

1. Agreement

By using this website, submitting a form, or accepting an estimate from 4th Gen Mechanical, LLC (“we,” “us,” “our”), you agree to these terms. If you don’t agree, don’t use the site.

2. What this site is for

This site provides information about our HVAC, cold-climate heat pump, and geothermal services, and a way to request quotes or contact us. Content is informational only. Nothing on this site is an offer to contract or a binding price quote until we confirm it in writing after an onsite evaluation.

3. Estimates and quotes

Our estimates are:

  • Provided free of charge after we’ve visited the property or reviewed plans
  • Based on the scope, equipment, and conditions visible at the time of estimate
  • Subject to revision if scope changes, unforeseen conditions appear, or equipment availability shifts
  • Valid for 30 days from the date written

A signed work order or contract governs the actual work and prices.

4. Diagnostic fee

We charge a flat-rate diagnostic fee to come out and identify an HVAC problem. The current fee is provided when you book. If you hire us for the repair, we credit the diagnostic fee toward the work. The fee is non-refundable if no repair is performed.

5. Service hours and emergency work

Our office hours for estimates, quotes, and non-urgent scheduling are Monday through Friday, 7 am to 4 pm. For active HVAC emergencies (no heat, no cool, active water damage), we operate a 24/7 emergency line. After-hours calls route to the owner on rotation with a 30-minute callback target. Emergency response is best-effort and subject to crew availability, weather, and existing commitments; nothing on this site guarantees arrival within a specific window.

6. Payment

We accept credit cards. Payment terms are specified in the work order. Past-due balances may accrue interest at the maximum rate permitted by New York law.

7. Warranty

Manufacturer warranties apply to the equipment we install per the manufacturer’s terms. We do not provide a separate labor or workmanship warranty from 4th Gen Mechanical beyond what is stated in writing on the signed work order. Call or email us before purchase if warranty terms are material to your decision.

8. Photos and job-site media

We may photograph completed work for portfolio, quality control, and advertising purposes. We don’t publish identifying information about customers without their consent. If you don’t want us taking portfolio photos at your property, let us know before work starts.

9. Disclaimer of warranties

This site and its content are provided “as is,” without warranty of any kind. Information may be out of date or contain errors. Don’t rely on it for decisions about your home’s mechanical systems without talking to a qualified technician.

10. Limitation of liability

To the fullest extent permitted by New York law, we’re not liable for indirect, incidental, consequential, or punitive damages arising from your use of this site or our services, including lost profits, lost data, or business interruption. Our maximum liability for any direct damages arising from this website is limited to $100 or the amount actually paid to us for the service in question, whichever is greater.

11. Governing law

These terms are governed by the laws of New York State. Disputes will be resolved in the state or federal courts located in Monroe County, New York, and you consent to that jurisdiction and venue.

12. Updates

We may update these terms from time to time. Changes are effective when posted. Continued use of the site after changes means you accept the updated terms.
